Terms of Service

These Terms of Service (“Terms”) govern your use of the Tlhakiso Stokvel app and website (the “Service”), provided by Hailio (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

Tlhakiso Stokvel is a record-keeping and transparency tool for stokvels, burial societies and other savings or investment groups. It helps a group record and share information about its own contributions, loans, payouts, claims, meetings and governance.

2. What the Service is not

The Service is non-custodial. It does not hold, receive, move, invest or guarantee any money, and it is not a bank, a deposit-taking institution, a payment service, or a registered financial service provider. All money belonging to a group stays in that group's own bank account and is controlled solely by the group and its members. Nothing in the Service constitutes financial, legal, tax or investment advice.

3. Your account

  • You must provide accurate information and keep your login credentials secure.
  • You must verify your email address to use the Service.
  • You are responsible for activity that happens under your account.
  • You must be at least 18 years old.

4. Your responsibilities and the group's responsibilities

  • You and your group are solely responsible for the accuracy of the records you enter and for the actual handling of the group's money in its bank account.
  • The group is governed by its own constitution and rules. Roles such as chairperson and treasurer, and the powers granted to them, are set by the group.
  • You must only add information about other people (such as members or covered family) where you are entitled to do so.
  • You must not use the Service for any unlawful, fraudulent or abusive purpose.

5. Subscriptions and fees

The mobile apps are free to use. Certain features may be offered on our website on a paid subscription basis, billed through our payment provider (PayFast). Pricing and what is included are shown before you subscribe. Where required by an app store, any purchases made through that store are governed by the store's billing terms.

6. Documents you upload

You are responsible for the documents you upload (such as bank statements, certificates and receipts) and confirm you have the right to upload them. We process them only to provide the Service, as described in our Privacy Policy.

7. Availability

We aim to keep the Service available and accurate but we provide it “as is” and “as available”. We may modify, suspend or discontinue features at any time.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied. Because the Service is a record-keeping tool and not a custodian of funds or a financial service provider, we are not responsible for any loss, shortfall, mismanagement, dispute or misappropriation of a group's money, or for decisions made based on records in the app. Our total liability arising out of or relating to the Service is limited to the amount you paid us (if any) for the Service in the 12 months before the claim.

9. Termination

You may stop using the Service and delete your account at any time (see Account & Data Deletion). We may suspend or terminate access if you breach these Terms or use the Service unlawfully.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa, and you agree to the jurisdiction of the South African courts.

11. Changes

We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date. Continued use of the Service after changes means you accept the updated Terms.
